OVERVIEW & LEGAL BINDING

This website (Entimessi.com) is owned and operated by Artists Integrated Business Private Limited ("AIBPL"), a private limited company incorporated under the Companies Act, having its registered office in Kolkata, West Bengal. Throughout these Terms of Service, the terms "we", "us", and "our" refer to AIBPL/Entimessi.

This document is an Electronic Record in terms of the Information Technology Act, 2000, and the rules thereunder. It does not require any physical or digital signatures.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including those additional terms, conditions, and policies referenced herein (such as our Privacy Policy and Refund Policy).

SECTION 1 - ONLINE STORE TERMS & ELIGIBILITY

By agreeing to these Terms, you represent that you are "Competent to Contract" under the Indian Contract Act, 1872. This means you are at least the age of majority (18 years) and are of sound mind. Minors may use this site only under the supervision of a parent or legal guardian.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to Copyright laws and the Information Technology Act, 2000).

A breach or violation of any of the Terms will result in an immediate termination of your Services and potential legal action.

SECTION 2 - GENERAL CONDITIONS & PLATFORM NATURE

We reserve the right to refuse service to anyone for any reason at any time.

Marketplace & Inventory Model: AIBPL operates Entimessi.com as an e-commerce platform. We may act as a seller of our own inventory or as an intermediary facilitating sales for third-party vendors. In cases where we act as an intermediary, our liability is limited under Section 79 of the Information Technology Act, 2000.

Data Transmission: You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS

Product Representation: While we strive to display product colors and images accurately, we cannot guarantee that your monitor's display will be accurate. Under the Consumer Protection (E-Commerce) Rules, 2020, we ensure that product descriptions are truthful; however, minor variations in fabric or color may occur.

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only. Any reliance on the material on this site is at your own risk.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We guarantee fair pricing practices but reserve the right to modify or discontinue the Service (or any part thereof) without notice at any time.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 5 - PRODUCTS, RETURNS & REFUNDS

Certain products or services may have limited quantities and are subject to return or exchange only according to our Return, Exchange, Cancellation and Refund Policy.

Strict Adherence to Refund Policy: By placing an order, you explicitly agree to our refund terms, which state that Store Credit is the default refund mode. Monetary refunds to the original source are subject to a 7-14 day transit and Quality Check (QC) period.

We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We reserve the right to discontinue any product at any time.

SECTION 6 - BILLING ACCURACY & FRAUD PREVENTION

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household, or per order.

Mandatory Verification: To prevent fraud and ensure compliance with COD (Cash on Delivery) norms, we reserve the right to verify orders via WhatsApp/SMS. Unverified COD orders may be cancelled.

You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.

SECTION 7 - THIRD-PARTY TOOLS & LINKS

We may provide you with access to third-party tools (e.g., payment gateways like Razorpay, logistics partners). You acknowledge and agree that we provide access to such tools "as is" without any warranties. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 - USER COMMENTS, FEEDBACK & CONTENT REGULATION

If you send us creative ideas, suggestions, or other materials ("comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, and use them.

Prohibited Content: Under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that:

  • Belongs to another person and to which you do not have any right.
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, including bodily privacy.
  • Is harmful to children.Threatens the unity, integrity, defense, security, or sovereignty of India.We reserve the right to remove such content immediately and terminate the user's access.

SECTION 9 - PERSONAL INFORMATION & DATA PRIVACY

Your submission of personal information through the store is governed by our Privacy Policy. We are committed to protecting your data in accordance with the Digital Personal Data Protection Act, 2023. We process your data solely for the purpose of order fulfillment and service improvement.

SECTION 10 - PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site:

  1. for any unlawful purpose;
  2. to solicit others to perform unlawful acts;
  3. to infringe upon our intellectual property rights;
  4. to harass, abuse, insult, harm, defame, slander, or discriminate;
  5. to submit false or misleading information;
  6. to upload viruses or malicious code;
  7. to collect or track the personal information of others;
  8. to spam, phish, or scrape.

SECTION 11 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of our service will be uninterrupted or error-free.

Limitation of Liability: In no case shall AIBPL, our directors, officers, employees, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, arising from your use of any of the service or any products procured using the service. Notwithstanding the above, our total liability to you for any claim arising out of or in connection with these Terms or the use of the Service shall be limited to the value of the Order giving rise to such claim.

SECTION 12 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AIBPL and our parent, subsidiaries, affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms.

SECTION 13 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

SECTION 14 - GOVERNING LAW & JURISDICTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the Laws of India.

Jurisdiction: You agree that the courts located in Kolkata, West Bengal, shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or your use of the Website.
